Father sues council over daughter’s tripping accident
The father of a five-year old girl is seeking compensation for his daughter after a trip on a broken pavement caused her to fall and injure herself.
Upon being taken to the hospital, Bailey was given painkillers whilst her parents were told how lucky she was not to have broken anything.
Taking action against Essex council, 45 year-old Ashley Smart explains that his complaint does not just stem from his daughter having had her accident, but because five weeks after her fall, the council has done nothing to repair the damaged pavement and thus prevent the accident from happening to anyone else.
Having seen the injuries his young daughter has sustained, Ashley comments that he ‘would hate to see what would happen to an elderly person if they had a fall there’.
The family had received a letter from the council explaining that the matter was undergoing investigation and that repair would be carried out as soon as possible, but it would appear that it was only after Mr Smart contacted a local newspaper with his complaint that anything was actually done.
The council have said they will deal with Mr Smart’s claim once their own assessments are complete.
